Please read these Terms of Service carefully. By using this website or engaging Cabrera Construction LLC for services, you agree to be bound by these terms. If you do not agree, please do not use this Site or our services.

1. About Cabrera Construction LLC

Cabrera Construction LLC is a licensed exterior home improvement contractor operating in Washington State (Contractor License No. CABRECL902DA). We provide roofing, siding, window installation, decking, door replacement, and gutter services to residential and commercial customers in Pierce County, King County, and surrounding areas.

2. Use of This Website

This website is provided for informational purposes and to facilitate contact between potential customers and Cabrera Construction LLC. By accessing or using this Site, you agree to:

  • Not attempt to gain unauthorized access to any portion of the Site or its related systems.

3. Estimates and Quotes

Submitting a contact form or requesting an estimate through this Site does not create a contract or obligate Cabrera Construction LLC to perform any work. All estimates are provided free of charge and without obligation to either party.

Estimates are based on information provided at the time of the request and are subject to change following an on-site inspection. Final pricing is confirmed in a written proposal or contract signed by both parties before any work begins. Cabrera Construction LLC does not begin work without a signed written agreement.

Estimates are typically valid for 30 days from the date of issuance unless otherwise stated in writing. Material price fluctuations, changes in project scope, or unforeseen site conditions discovered during work may affect final pricing and will be communicated to you before proceeding.

4. Service Agreements and Contracts

All construction services are governed by a separate written service agreement or contract executed between Cabrera Construction LLC and the customer. In the event of any conflict between these Terms of Service and a signed service agreement, the terms of the signed service agreement shall control.

Key terms that apply to all service agreements include:

  • Scope of Work. All work is performed as described in the written contract. Changes to scope require a written change order signed by both parties.
  • Payment. Payment terms, deposit requirements, and final payment schedules are specified in the service agreement. Cabrera Construction LLC accepts check, cash, and approved financing. Late payments may be subject to interest charges as specified in the agreement.
  • Permits. Where required by local jurisdiction, Cabrera Construction LLC will obtain necessary building permits. Permit fees are the responsibility of the customer and will be included in the project estimate.
  • Subcontractors. Cabrera Construction LLC is owner-operated and does not use subcontractors. All work is performed by our own trained employees.
  • Cleanup. We maintain a clean jobsite throughout the project and perform a final cleanup upon completion, including magnetic nail sweeps of the surrounding area.

5. Warranties

Cabrera Construction LLC provides a workmanship warranty on all installations. Specific warranty terms, duration, and coverage are detailed in your written service agreement. Workmanship warranties cover defects in installation resulting from our work and do not cover damage caused by acts of nature, improper maintenance, modifications made by others, or normal wear and tear.

In addition to our workmanship warranty, many of the products we install carry manufacturer warranties. These are separate from our workmanship warranty and are subject to the manufacturer's own terms and conditions. We will provide you with applicable manufacturer warranty documentation at project completion.

6. Financing

Cabrera Construction LLC offers financing options through third-party financing partners. Financing is subject to credit approval by the financing provider. Approval, interest rates, payment terms, and eligibility are determined solely by the financing provider and are not guaranteed by Cabrera Construction LLC. We are not a lender and do not make credit decisions.

Financing terms, including any promotional offers such as deferred interest or reduced monthly payments, are subject to the financing provider's agreement. Please review all financing documents carefully before signing. Cabrera Construction LLC is not responsible for disputes between customers and financing providers.

7. Communications Consent

By submitting a contact form on this Site and checking the consent checkbox, you authorize Cabrera Construction LLC to contact you regarding your project inquiry via phone call, text message (SMS/MMS), or email at the contact information you provided. This authorization includes the use of automated dialing systems or prerecorded messages where permitted by law.

You are not required to provide this consent as a condition of purchasing any goods or services from us. You may opt out of marketing communications at any time by replying STOP to any text message, clicking the unsubscribe link in any email, or contacting us directly. Opting out of marketing communications will not affect transactional communications related to an active project.

8. Intellectual Property

All content on this Site — including text, images, graphics, logos, video, and the overall design — is the property of Cabrera Construction LLC or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view and print content from this Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this Site without our prior written permission.

The Cabrera Construction name, logo, and related marks are trademarks of Cabrera Construction LLC. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.

9. Disclaimer of Warranties

This Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Cabrera Construction LLC does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Information on this Site is provided for general informational purposes only and does not constitute professional advice. Specific project recommendations are made only following an on-site inspection by a qualified Cabrera Construction representative.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Cabrera Construction LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or our services, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of this Site shall not exceed the amount you paid to Cabrera Construction LLC for the specific service giving rise to the claim, or $100, whichever is greater. This limitation does not apply to claims arising from our gross negligence or willful misconduct, or to the extent prohibited by Washington State law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cabrera Construction LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of this Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of this Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Pierce County, Washington.

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. 14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
